There were 353 votes in favor and 134 votes against. There was one abstention. 308 votes were needed for approval (see below). The PT, the president’s party, had 12 votes in favor of the PEC. The PL had 83 favorable votes, the Republicanos had 42, and the PRD had 5. These three parties had no votes against the proposal. On the other hand, deputies from PSOL and PCdoB voted entirely against the PEC: 14 and 9 votes, respectively. Deputies must analyze amendments — suggestions for changes in the text. Once this stage is completed, the proposal goes to the 2nd Round of voting, and only after this new approval will the PEC be sent to the Senate. The text allows parliamentarians, for example, to block the arrest of colleagues — determined by the Judiciary — in a secret ballot. Congress members in favor of the PEC claim that it restores the rules to the text of the 1988 Constitution. However, in reality, it adds new protections, such as secret voting for arrests. The PEC specifies that parliamentarians can only be subject to precautionary measures issued by the Supreme Court and not by lower instances. According to the text, before prosecuting a parliamentarian, the Supreme Court must request authorization from the Chamber and the Senate. Deputies and senators must authorize their colleague to be prosecuted in a secret vote and with an absolute majority, within 90 days from the receipt of the request. In the case of being caught in the act of an unbailable crime, the documents will be sent to the Chamber or the Senate within 24 hours, so that, through a secret vote by the majority of its members, the arrest and indictment of the parliamentarian can be authorized.
