Defendant in the Sports and Common Justice for allegedly deliberately receiving yellow cards to benefit bettors in a Brasileirão match in 2023, Bruno Henrique will begin to see his future in football defined today. The Flamengo forward will be judged in the First Instance of the Disciplinary Committee of the Superior Tribunal of Sports Justice (STJD), in downtown Rio de Janeiro, and may face penalties ranging from fines to a long suspension from the fields.
In which articles was Bruno Henrique framed? In August, the Prosecution accused the player and four other people, including his brother, Wander Nunes Pinto Júnior, under two articles of the Brazilian Code of Sports Justice (CBJD): 243 (to act deliberately in a manner detrimental to the team defended) and 243-A (to act contrary to sports ethics, with the purpose of influencing the outcome of a match).
What are the possible penalties for Bruno Henrique? Among the possible penalties are a suspension from 360 to 720 days – that is, up to two years; another suspension from 12 to 24 matches; and fines ranging from R$ 100 to R$ 200,000.
Will this trial close the case or can the parties appeal? Scheduled for 9 a.m., the trial will be the first step in defining the case in the sports sphere. If convicted, Bruno Henrique may appeal to the STJD Plenary, the Tribunal’s last instance, upon request for a suspensive effect – if acquitted, the Prosecution can equally appeal. There is also a chance that this initial chapter may not be concluded if any member requests further review.
Will Bruno Henrique attend the STJD? The player is unlikely to attend the hearing in person, as he is on a four-day break granted to Flamengo due to the FIFA date. Additionally, the presence of the defendant is not mandatory.
Why will Bruno Henrique be judged? Bruno Henrique is accused of sharing advance information about the yellow card received in a match against Santos at the Mané Garrincha stadium in Brasília on November 1, 2023. The move would have benefited his brother, Wander, who allegedly passed on the information to friends.
In addition to the duo, Claudinei Vitor Mosquete Bassan, Andryl Reis, and Douglas Barcelos were also accused by the STJD. Ludymilla Araújo Lima, Wander’s wife, and Poliana Ester Nunes Cardoso, Bruno Henrique’s cousin, are also involved but outside the STJD’s scope.
Since when has Bruno Henrique been under investigation? The case has been under investigation since August of last year by the Federal Police and the Public Prosecutor’s Office of the Federal District when three betting houses detected abnormal betting volume and movements on cards for the forward in that match. In November, a search and seizure of the player’s phone took place, but the STJD archived the case. In April of this year, Bruno Henrique was indicted by the Federal Police for fraud and fraud in sports competition. The organ had access to conversations between the player and his brother proving that the card information was being anticipated. In June, he was charged by the Prosecutor’s Office. If convicted to the maximum penalties in the common sphere, the player’s punishment could reach 17 years and eight months in prison.
How are Bruno Henrique’s defense and Flamengo preparing? Today, the STJD Prosecution plans to use as evidence a video in which Douglas Barcelos admits he knew in advance that the forward would force the punishment – he reached an agreement in the Common Justice. According to Diogo Dantas’ blog, Bruno Henrique’s defense considers the allegation that the yellow card was aimed at influencing the match or the championship being played as ‘absurd.’ The lawyers intend to argue that the STJD itself had already archived the case.
