CBF to have agency for Fair Play penalties and punishment for directors

The CBF’s Fair Play model, which was presented on Wednesday in Sao Paulo, will have an agency to define penalties for clubs that fail to comply with the rules. And punishments may also extend to directors who do not follow the regulations. The CBF’s Fair Play system has four pillars: control of overdue debt, operational balance, control of squad costs, and control of short-term debt. The essence of the main rules has already been published by the blog and confirmed by the confederation. The penalties range from warnings to transfer bans, point deductions, and relegation. There is an adaptation period for certain items. To implement the system, the National Agency for Football Regulation and Sustainability (Anresf) will be created to oversee and adjudicate. Two new developments are evident: 1) a tribunal will be established to determine penalties for clubs 2) club directors who violate the rules may also face penalties. The tribunal will be composed of individuals with expertise in law and finance, without connections to clubs. This tribunal will be supported by an anti-default system and a department to monitor club accounts. Clubs will be required to declare – three times a year – that they are up to date with debts to other clubs, players, and governments. Additionally, a system will verify the documentation of transactions between clubs. This declaration is crucial because directors will be subject to penalties if they provide false information. The regulations will include penalties for ‘administrators, employees, board members, and controllers’ of clubs. Among the punishable acts for executives are submitting false or misleading documents, participating in management actions that violate the regulations, and neglecting the duty to oversee and prevent.
