Dino orders Chamber to explain urgency in Adulteration Bill

Minister Flavio Dino, from the Supreme Federal Court (STF), ordered on Tuesday (26/8) that the Chamber provide information within 10 days about the urgency regime in the processing of the so-called ‘Adulteration Bill’, which creates a kind of Child and Adolescent Statute in the digital realm. Dino made the determination in response to a request from Deputy Marcos Pollon (PL-MS), who seeks to annul the procedure carried out by Chamber President Hugo Motta (Republicanos-PB), claiming it was an illegal act. The Chamber of Deputies approved on August 19 the urgent processing – i.e., without going through committees – of Bill no. 2,628/2022, known as the Adulteration Bill. As a result, the text was examined directly in the plenary the following day and approved. The opposition’s complaint is that when the STF was contacted, Marcos Pollon argued that the symbolic approval of urgency was illegal. He stated, ‘The opposition tried to carry out a nominal vote, a request made by Federal Deputies Marcel Van Hattem and Mauricio Marcon. Through its president, the urgency request for the processing of the Bill, known as the ‘Adulteration Bill’ or ‘Censorship Bill’, was approved by a symbolic vote. However, Hugo Motta ARBITRARILY stated that the matter was already closed and did not allow any discussions.’ According to the opposition parliamentarian, ‘by approving, via symbolic vote, the urgency request for processing Bill 2,628/2022, the Chamber’s President is blatantly violating our Constitution, leading to a true bypass of the legislative process, delegitimizing and tarnishing the entire evolution of the bill right from its inception.’ The decision by Dino was not to grant the injunction requested by the PL deputy. ‘I consider it indispensable to first present the information by the authority identified as the respondent in order to enable a careful and appropriate examination of the allegations put forward by the plaintiff,’ justified the magistrate. He mentioned that he will decide on Marcos Pollon’s request after receiving justifications from the Chamber.
