For the second time in Tuesday’s session, Minister Luiz Fux interrupted the vote of the rapporteur, Alexandre de Moraes, to complain about an intervention made by Flávio Dino during the trial of the coup plot. According to Fux, the members of the First Chamber had previously agreed that there would be no comments while one of the judges was voting. The episode highlighted the tension surrounding the analysis of the criminal action involving former president Jair Bolsonaro and seven other allies. ‘It was not what we agreed on in that room next door,’ said Fux, referring to the place where the ministers gather before entering the Chamber’s plenary. ‘The agreement was that the ministers would vote straight without interventions from other colleagues, although Minister Flávio Dino’s intervention was very appropriate, but I would like to comply with what we agreed.’ The President of the First Chamber, Cristiano Zanin, then stated that, in this case, the intervention had been ‘authorized’ by Moraes, who assented. ‘The request for intervention was made to me, not to you,’ Moraes retorted. ‘You can sleep soundly,’ added Dino.
