Minister Gilmar Mendes, from the Supreme Court (STF), ruled that only the Attorney General’s Office (PGR) can file impeachment requests against ministers of the Court and established that a two-thirds majority is necessary to initiate and approve the process. The decision is provisional and will be analyzed by the other ministers starting on December 12 in the Court’s virtual plenary. Currently, the 1950 law that defines the crimes of responsibility states that ‘any citizen’ can make accusations to the Senate against STF ministers and the Attorney General, and a simple majority is required both to receive the request and to consider it as valid.
