Considering Odete’s age, the total sum of sentences for the crimes committed would practically mean a life sentence in practical terms. Even in a ‘favorable scenario,’ where only minimum sentences were applied, the TCA owner would still face a total sentence of around 45 years of imprisonment. Due to the seriousness and volume of the crimes, her real-world situation would be ‘extremely grave,’ according to an expert.
The crimes that would weigh most heavily in the conviction would be the two qualified homicides and attempted homicides. The villain was responsible for the deaths of Ana Clara (shot) and Mário Sérgio (poisoned). Here, Odete committed the most serious crimes: qualified homicide, due to the cruel means used (poisoning) and, in the other case, the use of means that made the victim’s defense difficult (gunshots). The prescribed penalty is imprisonment from twelve to thirty years, as provided for in article 121, paragraph 2, of the Penal Code.
The businesswoman would also face charges of attempted qualified homicide, for trying to kill her ex-daughter-in-law Fátima and executive Marco Aurélio. The order to poison the mayonnaise that would be served in Paladar restaurants would also be classified as a crime, according to the expert. The penalty for the crime is imprisonment from 12 to 30 years, with a reduction of 1/3 to 2/3, depending on the circumstances. The ‘kidnapping’ of Fátima would carry a penalty of one to three years.
Odete would have to serve a significant portion of the sentence in closed regime, due to her criminal history and the heinous nature of the actions. Lawyer Rafael Valentini estimates that the character would have to serve ‘at least 20 to 25 years in closed regime.’ In the case of heinous crimes (such as homicide and attempted homicide), Odete would have to serve at least 2/5 of the sentence for each crime in a closed regime, and subsequently, 2/5 of the remaining balance in a semi-open regime (which is also served in a prison establishment, as a rule).
The list also includes offenses that affect public faith, property, and the Traffic Code:
– Ideological falsehood: Odete orchestrated the false information declaration in a public document by ordering the burial of a body under false identification, claiming it to be her son Leonardo;
– Mistreatment: Keeping her son isolated and hidden for years, if this action resulted in deprivation of essential food or care;
– Drunk driving and hit-and-run: Driving after drinking and hitting Nize’s husband;
– Corruption: For demanding participation in a corruption scheme involving Marco Aurélio and the change of destination of TCA aircraft. If characterized as active corruption (involving a public official), the penalty would be imprisonment from two to twelve years.
