Minister Alexandre de Moraes from the Supreme Federal Court (STF) authorized on Monday (29) that ex-deputy Daniel Silveira be transferred to house arrest – with restrictions like an ankle monitor and a prohibition on social media usage. Silveira was sentenced to 8 years and 9 months in prison, in a closed regime, and was fined five minimum wages (at the time), for the crimes of threatening the Democratic Rule of Law and coercion in the process. The sentence dates back to April 2022.
Daniel Silveira spent four years, one month, and 26 days in prison – more than 25% of the sentence – in a closed regime and proved the payment of a fine of R$ 271 thousand. Therefore, according to Moraes, ‘all legal requirements necessary for the progression of the inmate to the open regime of serving his sentence are present.’
Silveira also underwent a psychosocial evaluation, which indicated the inmate’s ability to perform work functions, according to the minister’s decision. The Attorney General’s Office (PGR) expressed support for the regime progression.
In the case of house arrest, Daniel Silveira will have to prove employment, wear an ankle monitor, and comply with rules of home confinement during off periods. He is also banned from using social media. The ex-deputy cannot leave Rio de Janeiro, where he lives, without judicial authorization, and must appear weekly in court to justify his activities.
Daniel Silveira was in a semi-open regime at the Magé Agricultural Penitentiary in Baixada Fluminense (RJ), but spent most of the day outside the prison and at home in Petrópolis, Serrana Region, as reported by the g1. The former congressman had permission to leave and return to the prison every day for physiotherapy on his knee, operated on in July.
After the surgery, reports presented by the defense claimed that he needed two daily sessions of physiotherapy. Therefore, the lawyers requested that Silveira be placed under humanitarian house arrest for six months, the estimated duration of the treatment.
On August 5th, Minister Alexandre de Moraes did not authorize house arrest. But he granted temporary outings for 30 days so that Silveira could leave the Magé prison and attend physiotherapy sessions at a private clinic in Petrópolis, in the Serrana Region, indicated by the defense. The former deputy’s residence is also in Petrópolis.
On August 26th, Moraes extended the outings for another 90 days. The reports presented by Silveira’s defense indicate that the former congressman needs physiotherapy every day. However, the clinic only operates from Monday to Friday.
