Moraes Orders Full Preservation of Evidence on Operation with Over 100 Deaths in Rio

Minister Alexandre de Moraes, of the Supreme Federal Court (STF), has determined the preservation of all materials serving as evidence regarding the actions of security agents in the operation that resulted in over 120 deaths on Tuesday, the 28th, in Rio de Janeiro. Moraes’ decision follows the precepts of Precept Fundamental Disregard Argument (ADPF) 365, the ‘favelas ADPF,’ published on Sunday the 2nd, meeting a request from the Federal Public Defender’s Office (DPU) aiming to ensure control and investigation of the case by the Public Prosecutor’s Office and the Defender’s Office. The state government will be notified of the decision. In the same document, Moraes denied requests from entities seeking to participate as amicus curiae in the judicial process regarding police actions, i.e., participating in legal discussions providing information to support decision-making.
