The Office of the Attorney General (PGR) has advocated for granting house arrest to retired general Augusto Heleno, former Minister of the Institutional Security Cabinet (GSI) under President Jair Bolsonaro. The 78-year-old military officer was arrested last Tuesday by the Supreme Federal Court (STF). During his medical examination after the arrest, Heleno stated that he has been suffering from Alzheimer’s since 2018.
Heleno is accused of being part of the ‘crucial nucleus’ of a criminal organization led by former President Bolsonaro, aiming to carry out a coup and keep him in power despite losing the elections. His defense filed a request for house arrest based on his health condition. In the submission, the Attorney General, Paulo Gonet, states that ‘the circumstances indicate the need to reassess the detainee’s situation.’
‘Keeping the detainee under house arrest is an exceptional measure proportional to his age and health condition, which has been properly documented and could be compromised if kept away from his home and the state’s mandatory and protective measures,’ the opinion states. The decision on whether to accept the PGR’s opinion and grant house arrest to the convicted individual lies with the case’s rapporteur at the Supreme Court, Justice Alexandre de Moraes. He will review the opinion and respond to the defense’s request.

Heleno was sentenced by the STF to 21 years in prison, with 18 years and 11 months in incarceration (closed regime) and one month in detention (semi-open or open regime), beginning with a closed regime for serving the sentence.
Arrest for the coup plot. Augusto Heleno was arrested by the Federal Police and the Army earlier this week after the case became final — meaning no further appeals can be made by the defense — and taken to the Military Command of the Planalto, in Brasilia. According to Gonet, the defendant’s situation is similar to other convicts who have been granted house arrest on humanitarian grounds by the Supreme Court.
The ex-president Jair Bolsonaro, sentenced to 27 years and three months in prison, is serving his sentence at the Federal Police headquarters in Brasilia, where he was already detained preventively. The former Minister of Justice, Anderson Torres, is serving a 24-year sentence at Papuda Federal Penitentiary. Likewise, Admiral and former Navy Commander Almir Garnier, also sentenced to 24 years, began serving his sentence at the Navy Radio Station in Brasilia. Generals and former Ministers Augusto Heleno and Paulo Sérgio Nogueira were sent to serve their sentences at the Military Command of the Planalto. Former Chief of Staff and Minister Walter Braga Netto will serve his 26-year sentence at the 1st Army Division in Vila Militar, Rio de Janeiro. He has been detained since December 2024.
